Gov. Kemp signs bill into law expanding job opportunities for military spouses

With our state experiencing a 7.6% unemployment rate in June (the most recent numbers available), it’s clear that every Georgian needs all the help possible to find and maintain stable employment. That’s why the Georgia Center for Opportunity team was excited to see Gov. Brian Kemp sign a new bill into law (HB914) that knocks down a significant barrier to employment for new Georgia residents.

 

The new law provides a temporary occupational license to spouses of members of the armed services who move to Georgia. Georgia has the 5th largest number of military, civilian direct-hire, reserve, and national guard employees in the U.S. Spouses of these employees will now have a greater opportunity to obtain employment in the career of their choice.

 

“Particularly in the COVID-19 era, breaking down barriers to employment is more important than ever,” said Buzz Brockway, vice president of public policy at Georgia Center for Opportunity. “Restrictions on occupational licensing can be an enormous one of these barriers. It’s the least we can do for our men and women in uniform to ensure that their spouses have the ability to work in their area of expertise in our state.”

 

Gov. Kemp signs ‘second chance’ expungement bill into law for ex-offenders

For many Georgians, past criminal conviction can be the most significant hurdle to overcome in getting a job. On this front, there is good news: Gov. Brian Kemp recently signed a bill (SB288) into law that allows formerly incarcerated individuals to petition the court to have certain misdemeanor convictions erased from their record four years after the completion of their sentence. 

 

The new law excludes certain offenses, including sexual offenses and DUIs. In a crucial move, the law also creates incentives for employers to make “second chance” hires.

 

This new law allows for an easier transition back into the workforce for a segment of Georgia’s population that has paid its debt to society and stayed on the straight and narrow.

 

“This new law is monumental because it takes Georgia off the list of only a handful of states where a criminal offense stays on an ex-offender’s record perpetually,” said Buzz Brockway, vice president of policy at Georgia Center for Opportunity. “We know that unemployment is a key way to help ex-offenders not repeat their crimes. Particularly in the COVID-19 era, breaking down any barriers to employment that we can is always a huge win. We applaud Gov. Kemp and the Georgia Legislature for making this law a reality.”

 

GCO reflects on the passing of Rep. John Lewis

The Georgia Center for Opportunity team was saddened to learn of the passing of U.S. Rep. John Lewis on July 17. Rep. Lewis served Georgia’s 5th congressional district from 1987 until the time of his passing this year. Rep. Lewis was a crucial figure in the civil rights movement of the 1960s—during the 1965 march across the Edmund Pettus Bridge in Selma, Alabama, he was beaten so badly by police that he was hospitalized.

 

Even though Rep. Lewis’ policy prescriptions did not always align with those of GCO, we commend his years of service fighting for equal justice and the chance for all Americans to thrive and prosper. Here are selected reflections from GCO staff members on the life and legacy of John Lewis.

 

Randy Hicks, president and CEO: “John Lewis was a warrior for justice, frequently calling America to live up to its lofty, well-articulated principles. We join with so many others across the state of Georgia and the country in mourning the loss of a man who committed his life to making America better.”

 

Joyce Mayberry, vice president of family formation: “The way civil rights icon and Georgia Congressman John Lewis lived his life was the epitome of impact. He forever changed my life and the lives of so many others. While I never got the chance to personally thank him, hopefully my personal decision to serve my community daily is an action that would have received his approval. Rest in peace, sir.”

 

Buzz Brockway, vice president of public policy: “I am sad that John Lewis passed away. He had courage to stand for what he believed in, even when he knew he would be beaten and he was putting his life in jeopardy. It’s easy to say we have that kind of courage, but he proved it. I’m glad I got the chance to shake his hand. Prayers for his family and friends.”

 

Jamie Lord, director of government affairs: I met John Lewis only once. Though shorter in stature, he loomed large. He was a sort of North Star in the moral quest for justice and equality. Before he was even born, I bought my son Congressman Lewis’ graphic memoir, March. I can only hope Lewis’ story helps inspire my son as it has inspired me. I hope he comes to live, as Lewis did, demonstrating a love of others, a commitment to justice and the bravery to put his very life on the line standing up for what is right. He really was one of the best of us and even in his passing he challenges me to be better, to do more.”


Highlighting Legislation Passed in the 2020 Georgia Legislative Session

 Ordinarily, the Georgia Legislature would have wrapped up its 40-day legislative session by the end of March. But 2020 is no ordinary year. As the pandemic spread, the Legislature suspended its session in mid-March with no return date announced. Eventually, lawmakers reconvened with 11 legislative days left to address a plethora of issues.

 

Looming large was the fiscal year 2021 budget, and as you can imagine, the budget outlook was much different in June than in March. State revenues plunged due to the shutdown and budget writers scrambled to decide the best path forward. After tapping into the state’s rainy-day fund, lawmakers passed a budget with 10 percent  cuts, approximately $2.2 billion smaller than originally proposed. No state department was spared, but some departments—like education—received smaller cuts than other departments. 

 

Apart from the budget, perhaps the issue that garnered the most attention was a hate crimes bill, HB 426. The murder of Ahmuad Arbery in Brunswick, GA, as well as the deaths of George Floyd and Breonna Taylor at the hands of police, created a political situation where ignoring this issue was impossible. Georgia previously had a hate crimes law that was declared unconstitutional by the State Supreme Court. HB 426, now signed into law by Governor Kemp, provides sentence enhancements after a person has been convicted of certain crimes motivated by bias against defined groups of people.

 

Two pieces of legislation we at the Georgia Center of Opportunity actively supported passed both houses and await the Governor’s signature. SB 288 allows a person convicted of certain non-violent misdemeanors, who have kept a clean record for a specific length of time, to seek to have those records restricted. This will allow these folks to have a better chance of employment. Another bill meant to assist people obtaining a job is HB 914. This bill will provide a temporary occupational license to spouses of members of the armed forces who move to Georgia. Georgia has a large number of military installations, so many people will benefit from this bill.

 

Other legislation of interest includes HB 888, which seeks to prevent “surprise billing.” A “surprise bill” occurs when an out-of-network physician treats a patient. These bills can become quite large. It is hoped this legislation will prevent this situation from occurring again. 

 

More progress was made in the fight against human trafficking as HB 823 and SB 435 passed.  HB 823 would prevent a truckdriver convicted of human trafficking of ever holding a commercial driver’s license again in Georgia. SB 435, known as the “Debbie Vance Act,” would allow a person convicted of trafficking to have their conviction vacated if they can prove they were a victim of human trafficking. 

 

Foster parents will be allowed to arrange for short-term babysitting under HB 912, which awaits the Governor’s signature. 

 

Government transparency and accountability got a boost with the passage of HB 1037. This bill would require audits on production companies seeking to take advantage of Georgia’s film tax credit. An audit earlier in the year revealed oversite problems in this very large tax credit. Price transparency for non-emergency medical services is the subject of SB 303, which was sent to the Governor’s desk. Empowering patients with pricing information can help lower costs for shopping of these non-emergency services. 

 

Despite the strange nature of the 2020 Legislative Session, many things were accomplished. The Georgia Center for Opportunity will continue to work hard to advance legislation to increase educational opportunity, knock down barriers to employment, and strengthen families. We look forward to continuing this effort in the next legislative session.

All Georgians Deserve to Participate in The Economic Recovery

The Coronavirus pandemic has caused massive numbers of people to lose their jobs. Georgia’s official unemployment rate is 9.7%. However, as we reported last week , many others are not employed but do not appear in the common reported unemployment number. 

 

A top goal of policy makers, and indeed all Georgians, should be to see people return to work as quickly as possible. Work is the best path to financial independence and a flourishing life.  

 

As we endeavor to rebuild our economy, we must look to remove barriers people face in returning to work. One significant barrier many people face is a criminal record. For those with a criminal record who lost jobs due to the pandemic shutdown, finding work again could be difficult. For ex-offenders who didn’t have a job, the task of finding one just became even more difficult. Our research estimates that approximately 250,000 healthy working age men had no job prior to the pandemic. The reasons for their lack of employment vary, but for many, a criminal record is the barrier keeping them out of the job market.  

 

What can be done to address this significant problem? In recent years, Georgia has focused on prison reentry programs meant to assist folks as they transition back into society. This work is important and must continue. But for those already back in society, other assistance is needed.

 

With Senate Bill 288, the Georgia Legislature has the chance to aid ex-offenders looking for work. The bill would allow an ex-offender, who has served his or her time and stayed out of trouble for a period of time, the opportunity to have certain non-violent misdemeanors expunged from the record. This will allow for an easier transition back into the workforce for a segment of Georgia’s population, who have paid their debt to society and stayed on the straight and narrow.

 

The benefit to our state in passing this legislation comes in several ways: Ex-offenders with jobs are less likely to recidivate. People who don’t get in trouble again cost the taxpayers less money and actually join the ranks of taxpaying citizens.

 

Ex-offenders with jobs are able to support their families, reducing poverty and lifting up the communities in which they live. If we want to break the cycle of poverty in our state, we must provide a path out for families. A job is the first step on the path to self-sufficiency and a flourishing life. 

 

We are in the final week of the 2020 Georgia legislative session. There are many important issues being debated and policies being discussed to make our state better. At the top of the list should be providing a path forward for folks who need our help. SB 288 is an excellent step in the right direction.

To Rebuild Trust in Law Enforcement, We Must Reform Civil Asset Forfeiture Laws

In the wake of the tragic deaths of George Floyd, Breonna Taylor, Ahmaud Arbery, and now Rayshard Brooks, issues of racism and questions about use of force by police dominate the news. Understandably, emotions are high as people want answers and change. The Georgia Center for Opportunity has worked diligently over the years on issues of criminal justice reform.  We see this as a key issue in pursuit of our goal of a society where everyone has the opportunity to flourish. We stand with our African-American sisters and brothers as they call for justice.

One key area in need of reform is called civil asset forfeiture. Civil asset forfeiture is a process in which law enforcement officers take assets from persons suspected of involvement in illegal activity without necessarily charging the owners with wrongdoing.  The assets are thought to be either obtained as a result of illegal activity, or used in the commission of a crime. A civil court proceeding takes place to determine if the assets are to be forfeited and the funds used for law enforcement purposes.

As solutions are being offered, it is important to keep in mind the vital role law enforcement play in protecting the vulnerable and seeking justice for victims. Human flourishing and freedom cannot take place in unsafe communities. Therefore, law enforcement can and should be a key part of the solution to issues such as racism and discussions about the proper application of force against those suspected of criminal activity.

While the facts surrounding each of the tragic deaths listed above differ, one common thread moving through each case is lack of trust. Lack of trust that officers will use force responsibly, lack of trust that officers will properly deal with arrest warrants, and lack of trust that prosecutors will prosecute crimes equally, especially crimes committed against the African-American community.  As we consider potential reforms, focusing our efforts on restoring trust between law enforcement and the communities they serve would seem to be efforts that could bear much fruit.

To that end, let me suggest we look at increasing transparency and oversight of Georgia’s civil asset forfeiture laws. The Georgia Center for Opportunity recently completed a study of these laws, how the system works, and made recommendations around increased transparency and accountability. 

 officers investigating a carCivil forfeiture of assets from law enforcement activities has become an important      funding mechanism for many law enforcement agencies as well as multi-jurisdictional task forces crucial to fighting criminal gangs. However, the issue raises concerns about justice, freedom and prosperity.  While a 2015 law made major improvements in civil asset forfeiture reporting requirements, it is not possible to know whether there was a conviction in the case that resulted in the property being forfeited. To restore trust, collecting this information is crucial.

Additionally, understanding the outcome of the case would allow us to determine if Georgia civil asset forfeiture laws violate the 8th Amendment prohibition on excessive fines. The recent Supreme Court decision in Timbs v. Indiana makes it clear that the 8th Amendment applies to the state. As it relates to civil asset forfeiture, is it an “excessive fine” to forfeit a car worth several thousand dollars for a minor drug conviction?  To restore trust in law enforcement, this question must be answered.

Rebuilding trust between law enforcement and the community will take time and many policies and practices must be reviewed and debated.  Increasing transparency and accountability in Georgia’s civil asset forfeiture laws is an important step in the right direction.
